& Conditions
The general terms and conditions that govern all orders, deliveries and services of Maison del Gusto SARL.

Scope and Applicability
1.1 These General Terms & Conditions (“GTCs”) govern all transactions between Maison del Gusto (“MDG”) and its clients. They apply to all agreements related to the sale and delivery of MDG products, including perishable goods, as well as to any other services provided by MDG unless otherwise agreed upon in writing. By placing an order with MDG, whether directly or through its website, the client acknowledges and agrees to these terms and conditions.
1.2 Any other terms that the client may seek to incorporate or which may be implied by trade or course of dealing are excluded unless explicitly agreed upon in writing by MDG.
1.3 To the extent of any inconsistency between any documents forming part of the agreement between the parties, these GTCs shall prevail except if expressly agreed otherwise.
1.4 These GTCs may be updated periodically. The latest version is always available on this page and upon request.
Pricing and Payment Terms
2.1 Prices are based on the information provided by the client regarding the type, quantity, and destination of the goods which are ordered. All prices are quoted in Euros unless stated otherwise and exclude taxes, duties and additional service charges.
2.2 Prices may be adjusted due to changes in raw material costs, fuel surcharges or currency fluctuations. MDG will notify clients of such changes within 48 hours of placing an order.
2.3 MDG’s invoices are payable on receipt. If an invoice remains unpaid after 30 days, MDG will be entitled to charge interest at the interest rate applied by the European Central Bank to its most recent refinancing operation, increased by 12 percentage points, which cannot in any case be less than three times the Monégasque legal interest rate, and shall apply a fixed indemnity of one hundred (100) euros for recovery costs.
2.4 Clients are not entitled to set off any amount against any payments due to MDG.
2.5 The parties are aware of international fraud and phishing risks and commit to never accept to transfer any sum due to the other party on a bank account which would have been notified by uncertified email or unreliable source. It is each party’s responsibility to satisfy the correctness of the bank account details provided before making any payment and each party agrees to comply with the other party’s verification procedure.
Delivery and Performance
3.1 Delivery dates are indicative only and not guaranteed unless expressly stated in writing. MDG will make reasonable efforts to meet agreed-upon delivery timelines.
3.2 Clients must ensure accurate and complete delivery information. Any additional costs incurred due to incorrect or incomplete details will be borne by the client.
3.3 MDG ensures that perishable goods are packed and shipped according to industry standards to maintain quality and safety during transport.
3.4 Risk and ownership of goods transfer to the client upon delivery to the specified address, or upon transfer to the carrier when shipment is arranged by the client.
3.5 If delivery cannot be completed due to client’s unavailability or refusal of the goods, MDG reserves the right to charge additional storage or redelivery fees.
Handling of Perishable Products
4.1 Perishable goods are shipped in temperature-controlled environments where applicable. Clients must inspect the goods upon delivery and store them immediately as per provided guidelines.
4.2 MDG is not liable for deterioration or spoilage due to delays caused by customs, incorrect handling after delivery or client’s non-compliance with storage requirements.
4.3 Clients must report any quality issues within 24 hours of receipt with photographic evidence. Claims submitted after this period may not be considered.
Products Subject to Age Restrictions
5.1 In accordance with the provisions of the Sovereign Order 2.533 of 15 October 1941 on the manufacture, sale and consumption of alcoholic beverages, the sale of alcohol to minors under the age of 18 is prohibited. Consequently, by placing an order for a product the sale of which is prohibited to minors, clients confirm that they are at least 18 years of age.
5.2 MDG operates an age verification policy to comply with its legal obligations. As part of this policy, MDG’s couriers may ask clients to provide proof that they are 18 years of age or over before delivering any age-restricted item. If a client is unable to provide valid photo identification to prove that it is over 18, MDG’s couriers will not be able to provide any age-restricted item. The client will still have to pay for the items in question and their delivery.
Client Obligations
6.1 Clients must provide accurate and complete order details, including product specifications, quantities and delivery instructions.
6.2 MDG caters for most dietary requirements and has strict policies in place for clients with food allergies. Clients with a specific food allergy or intolerance should inform MDG before or at the time of placing an order to ensure that the products, which have been ordered are suitable for them. This will ensure that MDG is able to take all reasonable precautions to avoid cross-contamination.
6.3 Perishable products must be inspected immediately upon delivery. Any discrepancies or defects must be reported in writing within 24 hours.
6.4 Clients are responsible for ensuring compliance with local regulations regarding the import, storage and handling of MDG products.
6.5 MDG products may not be resold or distributed without MDG’s prior written consent.
Liabilities and Insurance
7.1 MDG’s liability is limited to the value of the goods provided. MDG is not liable for indirect, consequential or incidental damages, including loss of profit.
7.2 MDG does not insure shipments unless explicitly requested and agreed upon in writing. Clients are encouraged to secure their own insurance for high-value or sensitive orders.
7.3 MDG is not liable for delays, losses or damages caused by force majeure events, including but not limited to natural disasters, strikes or governmental actions.
Cancellation and Returns
8.1 All orders are firm and final. However, a corrective message may be sent to MDG within 24 hours of the order being placed. After this time, no changes may be made.
8.2 Returns of perishable goods, including fresh or frozen items, are not accepted after delivery. Any goods returned at the time of delivery must be justified and approved by MDG. In cases where products are defective or incorrectly delivered, MDG will arrange for replacements or refunds at its discretion.
8.3 Refunds for non-perishable items are processed only after the returned goods are inspected and approved by MDG.
Intellectual Property and Confidentiality
9.1 Nothing in the performance of the services provided by MDG shall grant to the client any rights or consent to use any of its owned trademark or other intellectual property rights including without limitation know-how, design, trademark, logo, lay-out, data analytics, URL and source codes.
9.2 Confidential information shall not be disclosed except as necessary to allow MDG to perform its services and to comply with any applicable laws, regulations and requirements of any relevant jurisdiction.
Data Protection
10.1 The personal data entrusted to MDG is subject to computer processing in accordance with the provisions of Law no. 1.565 of 3 December 2024 on the protection of personal data. Further detail on how MDG processes personal data is set out in its Privacy Policy.
10.2 The main purposes for which MDG processes personal data are as follows: i) processing the client orders entrusted to MDG, ii) complying with legal obligations regarding client identification and iii) processing electronic mail.
10.3 Your personal data is kept for the time required to carry out your order and is then archived for a maximum of 10 years.
10.4 You have the right to access, rectify and delete your personal data, which you may exercise by sending an email to our privacy team or by post to Maison del Gusto SARL, Le Soleil d’Or, 7/9 Rue Louis Aureglia, 98000 Monaco.
10.5 If you believe that MDG does not comply with its obligations as regards data protection laws, you may bring a complaint to the Monégasque data protection authority (APDP) by writing to: Autorité de Protection des Données Personnelles, Le Concorde, 4th floor, 11 rue du Gabian, 98000 Monaco.
Dispute Resolution and Jurisdiction
Any disputes arising under these terms shall first be resolved amicably between the parties. If resolution cannot be reached, disputes shall be settled in the courts of Monaco, applying Monaco law.
